What is probate court and the probate court process?

Probate is a court process where the court oversees the distribution of a decedent’s property pursuant to their will or law if there was no will, and passes title to that property to the intended individuals. The process involves filing the decedent’s will in court, having a personal representative (executor) appointed, paying creditors, and distributing assets to the appropriate beneficiaries. If the person had a funded trust, probate court will not be necessary.
