A Will is a legal document that states how you’d like your assets distributed upon your death. You may dispose of your assets in any manner you choose with the exception that you cannot usually disinherit a spouse. In addition to disposing of your assets, a Will is the only place where you can appoint a Guardian for your minor children in the event of your untimely passing. A Will further allows you to appoint the person who will distribute your estate to the individuals you designate (the Personal Representative a/k/a Executor). Having just a Will does not avoid your assets going through Probate Court. Any property that passes under your Will must go through the Probate Court process.
