Adverse Possession is a method of acquiring real estate originally belonging to someone else by way of your extended use of that property. In Missouri, in order to obtain real estate by adverse possession, the person making the claim must prove that he/she had possession of the property that was hostile, actual, open and notorious, exclusive, and continuous for a 10-year period prior to commencement of the Adverse Possession lawsuit. One of the most common examples of Adverse Possession is when a fence diving 2 yards is not on the boundary line, but is several feet inside that line. If the neighbor cuts and maintains that property exclusively and openly for at least 10-years, that person may have a strong claim to ownership of that strip of land.
